If you are a foreign national or a permanent resident, and you are being detained, you have the right to an independent hearing to review, ascertain the reasons of your detention. When the Canada Boarder Service Agency detains you, CBSA must inform your case to the Immigration Division of the IRB. A member of the IRB (a decision maker) will then conduct a detention review hearing within 48 hours of that detention or as quickly as possible. The member will, at the end of your hearing, decide whether to release you or you stay in detention.Detention is a serious issue. Although you are allowed to represent yourself in the hearing, you probably want to hire a knowledgeable and experienced counsel to help you. A counsel can be a registered immigration consultant or a lawyer.
